These Terms and Conditions govern the purchase of goods by you, the Customer. We are HARMONY ESSENCE LTD, located at 71-75, Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom, with Company Number 14959320. The website is designed, owned and operated by HARMONY ESSENCE LTD.

Interpretation

• Consumer refers to an individual making a purchase for non-business purposes.
• Order refers to the legally binding agreement for the supply of Goods between you and us.
• Delivery Location refers to the specified place where the Goods will be delivered as indicated in the Order.
• Goods are the products advertised on our website, www.yogaccessori.com, which we supply to you based on the Order.
• Order is your request to purchase Goods from the Supplier, submitted through the step-by-step process outlined on the Website.
• Privacy Policy details how we handle confidential and personal information received from you via the Website.
• Website refers to our online shop www.yogaccessori.com, where the Goods are advertised.

Goods

• The description of the Goods is as displayed on the Website, in catalogues, brochures, or other promotional materials. Please note that any descriptions are for illustrative purposes, and there may be slight variations in size and color compared to the Goods received.
• In the case of Goods customized to your specifications, it is your responsibility to ensure the accuracy of any provided information or specifications.
• All Goods featured on the Website are subject to availability.
• We reserve the right to make necessary changes to the Goods to comply with applicable laws or safety requirements, and we will notify you of such changes.

Personal Information

• We collect and utilize all information in accordance with our Privacy Policy.
• We may contact you through email, other electronic communication methods, or pre-paid post, and you consent to this communication.

Basis of Sale

• The description of the Goods on our website does not constitute a contractual offer for the sale of Goods. Upon submitting an Order on the Website, we may reject it for any reason, and we will endeavor to communicate the reason to you promptly.
• The Order process is outlined on the Website, allowing you to review and amend any errors before submitting the Order. It is your responsibility to ensure correct use of the ordering process.
• The Order of goods is established only when you receive an email confirming the Order (Order Confirmation) from us. You must ensure the completeness and accuracy of the Order Confirmation and notify us immediately of any errors. We are not responsible for inaccuracies in Orders placed by you. By placing an Order, you agree to receive confirmation of the Order through email, including all relevant information (i.e., the Order Confirmation). You will receive the Order Confirmation within a reasonable time following the Order’s formation, but no later than the delivery of Goods under the Order.
• Any quotation is valid for a maximum of 30 days from the date issued unless we expressly withdraw it earlier.
• We have recently added a yoga sportswear section but have not yet added a size selector, however available sizes are shown below the product description, please specify in the comments or email when placing an order what size you are interested in.
• No alterations to the Order, whether related to the Goods’ description, fees, or other aspects, can be made after its formation unless both the Customer and Supplier agree in writing.
• These Terms and Conditions are intended to apply to Orders made by you as a Consumer. If this is not the case, please inform us so that we can provide you with an Order tailored to your specific needs.

Price & Payment

• The price of the Goods and any additional charges, such as delivery fees, is as displayed on the Website at the time of the Order or as otherwise agreed in writing.
• Payment is processed by submitting your credit or debit card details with your Order, and payment may be taken immediately or before the Goods are delivered.

Delivery

• We will deliver the Goods to the specified Delivery Location within the agreed timeframe or, in the absence of an agreement, without undue delay, and in any event, within 30 days from the Order’s formation.
• In case we fail to deliver the Goods on time, you have the option to consider the Order terminated under the following circumstances:
•We have refused delivery, or timely delivery is essential based on the relevant circumstances known at the time of Order formation, or you indicated before the Order’s formation that timely delivery was essential.
•After a failed on-time delivery, you specify a reasonable extended period, and we do not deliver within that period.
• In the event you choose to terminate the Order, we will promptly refund all payments made under the Order.
• If you are entitled to terminate the Order but choose not to do so, you still retain the right to cancel the Order for any Goods or reject Goods delivered. In such cases, we will promptly refund all payments made under the Order for canceled or rejected Goods.
• You agree that we may deliver the Goods in installments if we experience stock shortages or face other legitimate and fair reasons, subject to the conditions outlined above, and with no additional charges.
• If, through no fault of ours, you or your nominee fail to accept delivery at the Delivery Location, we may charge reasonable storage and redelivery costs.
• Once the Goods are delivered or collected by the Customer, they become the Customer’s responsibility. You should, if feasible, inspect the Goods before accepting them. Deliveries are conducted by a third-party delivery company, and while we make every effort to adhere to estimated delivery times, these times are approximate and not guaranteed. Therefore, we cannot be held liable for circumstances beyond our control causing delivery delays, and no compensation will be provided.

Risk & Title

• Risk of damage to or loss of the Goods passes to you upon delivery.
• Ownership of the Goods remains with us until full payment is received. If full payment is overdue or any step towards your bankruptcy occurs, we may, through notice, cancel any delivery and terminate your right to use the Goods still owned by you. In such cases, you must return the Goods or permit us to collect them.

Withdrawal, Returns, and Cancellation

• You have the right to withdraw the Order by informing us before the Order is formed, provided that you wish to cancel without specifying a reason and without incurring any liability.
• This is a distance Order, and it grants you Cancellation Rights as outlined below. These Cancellation Rights do not apply to a Order for goods made to your specifications or clearly personalized.

Right to Cancel

• You can cancel this Order within 14 days without providing any reason.
• The cancellation period expires 14 days from the day you, or a third party other than the carrier specified by you, physically receives the last of the Goods. In the case of a Order for the supply of goods over time (e.g., subscriptions), the right to cancel applies 14 days after the first delivery.
• To exercise your right to cancel, you must inform us of your decision to cancel the Order through a clear statement (e.g., a letter sent by post, fax, or email). While you can use the attached model cancellation form, it is not obligatory. In any event, you must be able to provide clear evidence of the cancellation’s timing, so you may choose to use the model cancellation form.
• You can also electronically complete and submit the model cancellation form or provide any other clear statement of your decision to cancel the Order through our website, www.yogaccessori.com. If you use this option, we will acknowledge receipt of your cancellation in a Durable Medium (e.g., via email) without delay.
• To meet the cancellation deadline, you must send your cancellation notice before the 14-day period expires.

Effects of Cancellation within the Cancellation Period

Unless stated otherwise below, if you cancel this Order, we will refund all payments received from you, including delivery costs (except for any additional costs incurred due to choosing a different delivery method than our standard, least expensive option).

Deduction for Supplied Goods

We may deduct from the reimbursement the loss in value of any Goods supplied due to unnecessary handling by you (e.g., handling the Goods beyond what is necessary to determine their nature, characteristics, and functioning; i.e., handling that goes beyond what is reasonable in a shop). You are responsible for that loss, and if no deduction is made, you must pay us the corresponding amount.

Returning Goods

If you have received Goods under the Order and subsequently cancel it, you must return or hand over the Goods to us without undue delay, and in any event, no later than 14 days from the day you notify us of the Order’s cancellation. The deadline is met if you return the Goods before the 14-day period expires. You are responsible for the cost of returning the Goods.

Conformity

• We have a legal duty to supply the Goods in conformity with the Order, and will not have conformed if it does not meet the following obligation.

Upon delivery, the Goods will:
• be of satisfactory quality.
• be reasonably fit for any particular purpose for which you buy the Goods, which, before the Order is made, you made known to us (unless you do not actually rely, or it is unreasonable for you to rely, on our skill and judgment) and be fit for any purpose held out by us or set out in the Order.
• conform to their description.
• Due to the nature of the design, the images for each product are a representation.
• We reserve the right not to send goods.
• We have a fast turnover of goods, which prevents us from accepting surplus products unless our warehouse has the same shade in stock.
